What is the West Tarum Canal Rehabilitation?
The rehabilitation of the West Tarum Canal (WTC) is one of the project of the Integrated Citarum Water Resources Management Investment Program (ICWRMIP - the Citarum program), which is carried out by the Directorate General of Water Resources (DGWR), Ministry of Public Works as the Executing Agency. The Citarum program will be implemented in stages over a period of about 15 years and will cover the entire Citarum River Basin, traversing a total of 9 districts plus 3 municipalities in the province of West Java.
The total length of the WTC project is 54.2 km, from Curug weir in Karawang District to Bekasi Weir in Bekasi City. Therefore the WTC project will include Karawang District, Bekasi district and Bekasi City. The main objective of the WTC project is to provide clean water and sanitation for families along the canal, enhance farm productivity, and improve Jakarta’s water supply.

What are the impacts of the WTC project to the people living and/or having business along the canal?
From the initial WTC design, clearance area is 6 meter from right and left side of the canal. Based on the survey carried out in 2008 based on the initial design during project preparation, a total of 872 households and 20 government agencies would be impacted by the WTC project.
Of 872 affected households (AHs) identified in 2008 survey, 515 AHs would have been relocated. None of the AHs have any legal ownership of the land. This information from the 2008 survey is part of a draft resettlement that needs to be updated and confirmed once the Detailed Engineering Design (DED) is finalized.
What is RP updating, and why it should be updated?
As the preparation of the draft RP was based only on preliminary technical design for WTC, an updating of the draft RP is required based on the final technical design of the WTC project. The updating of the draft RP will be prepared in consultation with APs and concerned groups. The final RP will include updated data on APs, impacts on assets and livelihood, livelihood restoration program and compensation (as in description later)
Who is responsible for resettlement activities and Project Implementation?
The Directorate General of Water Resources (DGWR), Ministry of Public Works has overall responsibility for the Citarum program and the Balai Besar Wilayah Sungai Citarum (BBWSC) has overall responsibility for implementing the WTC Project.
In Karawang District, Bekasi District and Bekasi City, resettlement working groups (RWGs) have been established comprising elements of BBWSC, local governments and related institutions. RWGs have overall responsibility for the RP updating and implementation. RWGs will be supported by facilitators in the field.
What are the key principles of resettlement under the WTC Project ?
The WTC project core principles for resettlement are to ensure that APs are not worse off from the WTC project and to provide an opportunity for the local population to derive benefits from it, this includes the following:
a. Displacement of people from assets and sources of livelihood will be avoided and/or minimized as much as possible;
b. All APs residing, working, doing business and/or cultivating land within the WTC project impacted areas prior to the cut off date on 31 May 2008 and APs who are identified in the updated RP based on the final technical design, are entitled to compensation for their lost assets (land use and/or non-land assets), in the form of in-kind, relocation facility and Livelihood Restoration Program-LRP.
c. APs registered in the Resettlement Plan 2008 and evicted by local governments and would have been under the updated RP, will be entitled to compensation as defined in the updated RP;
d. APs will be fully consulted and updated about the WTC Project. Special attention would be given to the vulnerable groups and women.
e. The BBWSC together with RWG will carry out its best efforts to expedite implementation of the resettlement plan. Acquisition of assets, the resettlement, and start of the livelihood rehabilitation activities of APs, will be completed prior to any construction activities taking place in a portion of the WTC.
f. There shall be effective mechanisms for hearing and resolving grievances during implementation of the resettlement plan
What are the entitlements of APs in WTC project?
The detailed category of lost assets and income as well as project resettlement entitlement is recorded in the RP, the main principles of entitlements of APs as follows:
a) Loss of houses and other related structures regardless ownership of building permit
b) Loss of public infrastructure and facilities owned by government.
c) Loss of annual crops, perennial crops and timbers;
d) Loss of business income, transport and transitional support for relocated APs will be addressed through the livelihood restoration program;
e) The livelihood restoration program (LRP) will be provided to those APs who are significantly affected and considered vulnerable including poor people, farmers losing livelihood, households headed by women and by elderly, APs losing entirely structures, APs losing entirely shops/stalls and APs will engage in totally different livelihood.
f) The APs who will not be relocated but lose access in using waterway for toilet, laundry, and water sources will be provided with awareness raising program on sanitation and clean water as well as communal sanitary toilet and clean water facilities in selected points along the WTC.
Point a) to d) are entitled to compensation for their lost assets (land and/or non-land assets), at replacement cost and existing local government regulations on pricing standard on building, crops, and trees if available would be a reference in the calculation of compensation in the form of livelihood program, facilitation, relocation and in-kind.
The APs who have received compensation are not allowed to return to the clearance area along the WTC. Should the APs return to the clearance area, and at anytime the construction work will be started, the returned APs will not be entitled for any additional compensation.
Who are eligible to be compensated and assisted under the WTC Project?
APs who are entitled to be compensated are (i) APs registered in the Resettlement Plan 2008 (ii) New APs who are identified in the survey of RP updating (iii) APs who were evicted by local governments in 2009 – 2010 and registered in the updated RP 2008.

How are the grievances of APs heard and resolved?
Resolution of grievances related to any aspect of updating the resettlement plan document, will pass through stages as follow:
i. First stage - the Camat and Desa/Lurah Level
An AP may bring his/her complaint to the village Chief (kepala desa/lurah) or Sub District Chief (Camat), or the RWG or its facilitator, either in writing or verbally. If the complaint is brought to the attention of the RWG, it will notify the Kepala Desa/Lurah about the complaint who will inform the Camat. The Camat together with Kepala Desa/Lurah and RWG will have 14 days to resolve the complaint following their notification.
ii. Second stage – The Bupati/Walikota Level
If after 14 days the AP does not obtain the solution of the complaint, or if the AP is not satisfied with the decision taken, the AP may bring the complaint, either in writing or verbally, to the Bupati (Head of Regency or District) or the Walikota (City Mayor). The Bupati or Walikota will have 30 days following notification of the complaint to resolve the case. If needed, he/she may call on the aggrieved AP, the RWG, and BBWSC to help him/her come up with an acceptable resolution of the complaint.
iii. Third stage – the Provincial Level
If after 30 days the aggrieved AP does not obtain the solution from the Kabupaten/Kota, or if is not satisfied with the decision taken by the Bupati or Walikota, the AP may bring the complaint, either in writing or verbally, to the Office of the Provincial Governor. The Governor has 30 days within which to resolve the complaint.
iv. Final stage – Legal Arbitration
If after 30 days of registering the complaint, the AP does not obtain the acceptable solution from the Kabupaten/Kota and/or Propinsi, the complaint may be brought to a court of law for adjudication.
How to monitor the resettlement plan updating and implementation?
There are two kinds of monitoring to be carried out, namely:
Internal Monitoring
BBWSC will ensure internal monitoring and supervision to be carried out with the following objectives RP updating is accurate, transparent and in accordance with the resettlement principles.
External Monitoring
An external monitor will be engaged to provide in independent periodic review and assessment of (i) RP updating is accurate, transparent and in accordance with the resettlement principles; (ii) achievement of resettlement objectives; (iii) changes in living standards and livelihoods improvement are achieved; ( (iv) the need for further mitigation measures.
